The Data Regulation (EU Regulation 2023/2854)

Regulation (EU) 2023/2854 of the European Parliament and of the Council of 13 December 2023 on harmonised rules on equitable access to and use of data and amending Regulation (EU) 2017/2394 and Directive (EU) 2020/1828 (the ‘Data Regulation’) entered into force on 12 September 2025.

This regulation aims to respond to the challenges and opportunities arising from the increasing availability and use of data in the EU, emphasising fair access, user rights and the fair sharing of value generated between stakeholders. It also aims to stimulate a competitive market, open up new opportunities for data-driven innovation and make data — in particular from connected products — more accessible.

The Data Regulation applies to all players in the EU data economy, including:

  • manufacturers of connected products;
  • providers of related services and data processing services;
  • users, holders and recipients of data;
  • public sector bodies and EU institutions in situations of exceptional need; as well as
  • participants in data spaces and sellers of applications using smart contracts..
